Terms of Use

These Terms explain the rules for using HireFairy, including customer responsibilities, acceptable use, payments, ownership, availability and reasonable liability protections.

1. Agreement to these Terms

These Terms of Use govern access to and use of HireFairy, including the website, public job pages and recruitment workspace. By creating an account, accessing a workspace or using the service, you agree to these Terms.

HireFairy is operated by HireFairy Limited, a company registered in England and Wales under company number 17326702. Our registered office is 1007 London Road, Leigh-On-Sea, United Kingdom, SS9 3JY. You can contact us at hello@hirefairy.io.

2. The HireFairy service

HireFairy provides software tools for creating jobs, collecting applications, managing candidates, scheduling interviews, sending candidate communications and organising talent pools.

We may improve, change, suspend or discontinue parts of the service over time. We will aim to avoid materially reducing core paid functionality without reasonable notice where practical.

3. Accounts and workspace access

You are responsible for the accuracy of account information, for controlling access to your workspace and for all activity that occurs under your account.

  • Keep login credentials secure and do not share accounts.
  • Ensure team members have appropriate permissions.
  • Tell us promptly if you suspect unauthorised access.
  • Use HireFairy only for lawful business recruitment purposes.

4. Customer data and candidate data

You retain ownership of the job, candidate, application, document and workspace data you upload or collect through HireFairy. You grant us the rights needed to host, process, transmit, display, back up and support that data in order to provide the service.

You are responsible for ensuring that your use of HireFairy and any recruitment data you collect complies with applicable employment, equality, privacy and data protection laws.

5. Acceptable use

You must not misuse HireFairy or use it in a way that could harm candidates, customers, the platform or other users.

  • Do not upload unlawful, discriminatory, misleading, abusive or malicious content.
  • Do not attempt to access data, accounts or systems without permission.
  • Do not interfere with platform security, availability or performance.
  • Do not use HireFairy to send spam or unauthorised communications.
  • Do not reverse engineer, scrape, resell or copy the service except where expressly allowed by law or agreed in writing.

6. Candidate communications

HireFairy may allow you to send automated or manual emails to candidates. You are responsible for the content, timing, recipients and legal basis for communications sent from your workspace.

We may apply reasonable safeguards to reduce abuse, protect deliverability and comply with provider requirements.

7. Subscriptions, trials and payments

Paid plans, trials, renewal periods, fees and payment terms will be shown at sign-up, in an order form or in the billing area. You agree to pay applicable fees when due.

Unless stated otherwise, fees are exclusive of taxes and are non-refundable except where required by law or expressly agreed in writing. We may suspend or limit access for overdue payments after reasonable notice.

8. Intellectual property

HireFairy, including its software, designs, branding, workflows, content and documentation, is owned by HireFairy or its licensors. These Terms do not transfer any ownership rights in the platform to you.

Feedback or suggestions you provide may be used to improve HireFairy without obligation to you.

9. Service availability and support

We aim to provide a reliable service, but HireFairy is provided on an as available basis. Access may be interrupted for maintenance, upgrades, provider outages, security issues or circumstances outside our control.

We will use reasonable efforts to restore service promptly where issues arise.

10. Disclaimers

HireFairy helps manage recruitment workflows but does not make hiring decisions, provide legal advice or guarantee hiring outcomes. You remain responsible for decisions made using the platform.

To the fullest extent permitted by law, we disclaim implied warranties, including fitness for a particular purpose, merchantability and non-infringement.

11. Limitation of liability

Nothing in these Terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to the previous sentence, HireFairy Limited will not be liable for indirect, special, incidental or consequential losses, loss of profits, loss of revenue, loss of goodwill, loss of business opportunity or loss of data. Our total liability arising out of or relating to the service is limited to the fees paid by you for the service in the 12 months before the event giving rise to the claim, or GBP 100 if no fees were paid.

12. Suspension and termination

You may stop using HireFairy at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees, create security or legal risk, or use the service in a way that may harm HireFairy, candidates or other users.

After termination, access to the service may end and data may be deleted after a reasonable period, subject to legal, backup, security and accounting retention requirements.

13. Confidentiality

Each party may receive non-public information from the other. The receiving party must protect confidential information using reasonable care and use it only for purposes connected with the service, unless disclosure is required by law.

14. Changes to these Terms

We may update these Terms as HireFairy develops or legal requirements change. The Last updated date shows when the Terms were most recently revised. Continued use of the service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where applicable law gives you mandatory rights to bring claims elsewhere.
